If a debt collector is calling you, they must disclose that they are a debt collector attempting to collect a debt
Are debt collectors contacting you at home? On your cell phone? At your place of employment? The FDCPA, a federally enacted statute created to protect consumers from harassing debt collectors, specifically mandates that debt collectors provide consumers notice that the debt collectors call is from a debt collector. Specifically, 15 U.S.C. 1692e(11) states that a debt collector must disclose in the initial communication with a consumer that “the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose,” and in any subsequent communication that “that the communication is from a debt collector.”
Debt collectors will routinely omit this mandated statement in their phone calls to consumers. By failing to provide consumers this notice as mandated by the FDCPA, the debt collector purposefully leaves the consumer confused as to whether or not the conversation they just engaged in was with a debt collector.
